A lack of clarity exists because there is no single decisive federal requirement, singular guidance on compliance, and associated fixed penalties. The most important thing to know is that there is a tide of legal action taking place regarding website ADA accessibility. This stems from, but not totally, the US Supreme Court’s rejection of hearing a lower court decision regarding the ADA. A Circuit Court found that websites should be considered public spaces and thus require equal accessibility for all people.
This broad decision has formed the basis for legal action against websites that are non-ADA Compliant. And, lawyers are catching onto the revenue potential of pursuing ADA cases with more demand letters to companies of all sizes being issued every day.
What is ADA Website Compliance?
Websites must comply with a wide set of standards or be subject to legal action. Remediation can be challenging because there are so many factors involved and researching the diverse and growing guidelines is not simple. However, ultimately ADA compliance will become de facto and those who fail to comply will be hit with significant costs.
